US Judge Orders Release of Abrego Garcia from Immigration Custody
A federal judge has ruled the immediate discharge of Kilmar Abrego Garcia from immigration custody, finding his continued confinement is without lawful basis.
"Since his release after wrongful detention in El Salvador, he has been taken back into custody, again without lawful authority," the judge wrote in her order.
The case stems from a erroneous removal to El Salvador in March, which US authorities later acknowledged was an error. Following his repatriation to the United States to face alien smuggling charges, he was detained in immigration detention.
In her order, the court pointed out that the authorities lacks a valid deportation order, which effectively blocks them from removing Mr. Abrego Garcia "at this juncture."
Context of the Case
The court proceedings center on conflicting assertions. Whereas the Trump administration argues that Abrego Garcia is a affiliate of the MS-13 gang, he vehemently disputes this allegation.
He has also pleaded not guilty to the conspiracy charges, which are part of a ongoing criminal case in Tennessee.
Conditions of Freedom
The court, who was hearing his challenge to deportation in a federal court, ruled that he must now comply with the conditions of his bond from custody in Tennessee. This decision shifts his supervision to the Tennessee court.
This decision marks a notable development in a complicated legal battle involving allegations of mistaken imprisonment and contested criminal associations.
